MISSOURI STAR QUILT COMPANY GOLDEN STAR 2024 PROMOTION OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. THE PROMOTION IS INTENDED FOR THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW.  DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.  VOID WHERE PROHIBITED OR RESTRICTED BY LAW.  PARTICIPATION IN THE PROMOTION IS SUBJECT TO THE PROMOTION DETAILS AND TERMS AND CONDITIONS OF THESE OFFICIAL RULES.

1. Eligibility

 

The Missouri Star Quilt Company Golden Star 2024 Promotion (the “Promotion”) is open to legal U.S. residents residing in the fifty (50) United States, the District of Columbia, (excluding Guam and all other U.S. foreign territories and possessions), who are at least eighteen (18) years of age or the age of majority, whichever is older, in their respective states of permanent residence. Void where prohibited or restricted by law. Employees of Missouri Star Quilt Company or any of its affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Promotion and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these rules (the “Official Rules”) and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

 

2. Sponsor

 

The Promotion is sponsored by Missouri Star Quilt Company, Inc. (the “Sponsor”).

 

3. Timing

 

The Promotion begins on September 9, 2024, at 12:01 AM CST and ends on October 2, 2024, at 11:59 PM CST (the “Promotion Period”).

 

4. To Participate

 

During the Promotion Period, entrants will automatically receive one (1) digital Golden Star entry spin directly to their online account with Sponsor for each $10 spent by entrants (excluding shipping, handling, and tax) at Sponsor’s in-person store or online. Entrants who wish to participate without making a purchase may request a free digital Golden Star entry spin by sending a hand-written postcard with their name, mailing address, and a valid email address to: Missouri Star Golden Star, P.O. Box 210, Hamilton, MO 64644. One (1) free digital Golden Star entry spin will be provided per postcard mailed and each free digital Golden Star entry spin shall entitle the holder to the same rights that an entrant with a purchased digital Golden Star entry spin has. All requests must be postmarked by September 9, 2024, and received no later than October 2, 2024.  

 

Once an entrant has made a purchase or their mail in entry(s) has been processed, the entrant will visit their Missouri Star Quilt account online via https://www.missouriquiltco.com/pages/sweepstakes. If an entrant does not have an online account with Sponsor, Sponsor will create an online account for entrant, and by mailing in a postcard for digital Golden Start entry spins, entrant consents to Sponsor creating such account on entrant’s behalf. From there, the entrant will click “play” to spin for a chance to win a prize (as described below). Each digital Golden Star entry spin equals one spin, or stated otherwise, one chance to win a prize. A digital Golden Star entry spin does not guarantee you to win a prize.  Entrants will have between September 9th, 2024 to October 2nd, 2024, at 11:59 pm CST to redeem their digital Golden Star entry spin(s). After October 2, 2024, each unclaimed digital Golden Star entry spin, and any associated prizes, lose all value. All entries are subject to verification by Sponsor.

5. Prizes

 

During the Promotion Period, Sponsor will award one hundred forty-six thousand one hundred and two (146,102) prizes, plus three “Grand Prizes,” all described below. Following each spin by an entrant, Sponsor will reveal what prize, if any, an entrant has won, subject to verification and compliance with these Official Rules. The description, quantity, and approximate retail value (“ARV”) (where determinable) for each prize are described in the Prize List, below. You are not guaranteed to win a prize. Other conditions and restrictions may apply.  The following prizes will be awarded:

The potential winners for each Grand Prize (the "Grand Prize Winners”) will be drawn on or about October 9th, 2024. Sponsor will randomly select which potential Grand Prize Winner will receive each respective Grand Prize. Grand Prizes cannot be traded.

Sponsor anticipates that the potential Grand Prize Winners will be contacted either by phone, email, in writing, or in person via a visit by Sponsor representatives at the Grand Prize Winner’s home or other location on or around October 9, 2024 (subject to change) and will be required to respond to the notification within forty-eight (48) hours indicating whether they can accept the prize. The potential Grand Prize Winners may be filmed or otherwise recorded during such a visit by Sponsor. Entrants are advised to add info@missouriquiltco.com to their contacts list to ensure that any email notification is delivered to their inbox. If no response is received within the time allotted, an alternate potential Grand Prize Winner will be randomly selected (time permitting). Any alternate potential Grand Prize Winner selected will also be required to respond to the notification within forty-eight (48) hours. The Sponsors are not responsible for suspended or discontinued Internet, wireless, or land-line phone service which may result in a potential Grand Prize Winner not receiving initial prize notification. The Grand Prize Winners will be required to execute an affidavit of eligibility, a non-disclosure agreement, and release of liability and publicity (where permitted by law), and return same, fully-executed, within five (5) business days of date of issuance of prize notification. If Sponsor is unable to contact the potential Grand Prize Winner within five (5) business days of the initial attempt, if the potential Grand Prize Winner fails to return all requested forms fully-executed by the specified date, or if the potential Grand Prize Winner(s) fails to comply with these Official Rules, including traveling on the dates and times required by Sponsor, his/her prize will be forfeited at Sponsor’s discretion, and an alternate Grand Prize Winner shall be selected. Sponsor reserves the right to select the winner in a random drawing format that shall be determined by Sponsor. Odds of winning depend on the number of eligible entries.

The aggregate ARV of all prizes is approximately $873,761 USD. Prizes are non-transferable. No substitution, cash redemption, assignment or transfer of prize permitted, except by Sponsor, who reserves the right in its sole discretion to substitute a prize with another prize of greater or equal value. All federal, state and local taxes, if any, related to a prize are the responsibility of the individual winner.

*Each Golden Star card is valid towards a future purchase at Sponsor’s on-site location or Sponsor’s online store and cannot be combined with any other offer or sold or redeemed for cash. Entrants have until October 31, 2024 to redeem any Golden Star Card awarded to them.

 

6. Verification of Potential Winners

 

POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential winners may be required to sign and return to Sponsor, within five (5) business days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim their prize. If a potential winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, or if the prize or prize notification is returned as undeliverable, potential winner forfeits the prize. In the event that a potential winner of a prize is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.

 

7. Travel and Accommodation (If Applicable)

The following section only applies to the Grand Prize Winner of Grand Prize #1. Air transportation provided by Sponsor will be economy class; if Grand Prize Winner and/or guest desires business or first class travel, Grand Prize Winner and/or guest shall be responsible the difference between the economy class rate and the rate selected by Grand Prize Winner and/or guest. If Grand Prize Winner resides within one hundred (100) miles of Hamilton, MO, ground transportation may be provided in lieu of air transportation, and no compensation will be provided for any difference in prize value. If the Grand Prize Winner elects to travel without a guest, no additional compensation will be awarded to the Grand Prize Winner. Travel and accommodations are at the Sponsors’ discretion and subject to availability and change. Grand Prize Winner and guest must travel on the same itinerary and on the dates agreed upon by the Grand Prize Winner and Sponsor or the prize will be forfeited and awarded to an alternate winner (time permitting). Grand Prize Winner and guest must comply with all travel requirements, which may include, without limitation, presenting necessary identification (including a valid driver’s license) at the time of travel. Flight schedules are subject to change without notice. Sponsor is not liable for any missed events or opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay or in the event Grand Prize Winner and/or guest misses a scheduled airline flight. Grand Prize Winner may be required to provide a credit card at time of hotel check-in. Any costs incurred due to changes to the original itinerary are solely the Grand Prize Winner’s responsibility. Additional ground transportation, additional meals, gratuities, trip cancellation insurance, personal purchases and all other expenses not specified herein are solely the Grand Prize Winner’s responsibility.

8. Entry Conditions and Release

 

By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Promotion; (b) release and hold harmless the Sponsor, and its parents, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Promotion, and all of their respective past and present officers, members, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Promotion, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an entrant’s participation in the Promotion and/or entrant’s acceptance, use or misuse of prize.

 

9. Publicity

 

Except where prohibited, participation in the Promotion constitutes each winner’s consent to Sponsor and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

 

10. General Conditions

 

Winnings are void if not obtained through authorized, legitimate channels, or if any part of the winning entry is defective, altered, duplicated, forged, counterfeited, mutilated or tampered with in any way.  Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, for any reason or if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

 

11. Limitations of Liability

 

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Promotion; (d) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

 

12. Disputes

 

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of entrants and Sponsor in connection with the Promotion shall be governed by the laws of the state of Missouri without giving effect to any choice of law or conflict of laws rules. Any legal claims arising from or relating to the Promotion or these Official Rules must be brought in the federal or state courts located in Caldwell County, Missouri.  Entrant agrees that (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (iii) except for residents of the State of New Jersey, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All descriptive headings of sections and paragraphs are intended solely for convenience, and no provision of this Agreement is to be construed by reference to the heading of any section or paragraph. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with the law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable, or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

13. Additional Terms

Sponsor may, to the maximum extent permitted by applicable law and in our sole discretion, change these rules or cancel the Promotion at any time; or modify, terminate, or suspend the Promotion should viruses, worms, bugs, unauthorized human intervention or other causes beyond our control corrupt or impair the administration, security, fairness or proper play of the Promotion or submission of entries. Sponsor is not responsible for: (a) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by entrant or by any of the equipment or programming associated with or utilized in the Promotion, or by any technical or human error that may occur in the processing of entries; (b) any printing or typographical errors in any materials associated with the Promotion; (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) injury or damage to your or any device resulting from downloading any materials in connection with the Promotion. Sponsor may, in it’s sole discretion, disqualify any individual found to be: (x) tampering with the entry process or the operation of the Promotion or website; (y) acting in violation of these rules; or (z) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. If your entry is incomplete or if you use robotic, automatic, programmed or similar entry methods, your entry will be void. The authorized subscriber of the e-mail address associated with any account used to enter the Promotion at the actual time of entry will be deemed to be the participant and must comply with these Official Rules. In the event of a dispute as to entries submitted by multiple users having the same email address, the authorized account subscriber is the natural person who is assigned an email address by an internet access provider, on-line service provider, or other organization responsible for assigning email addresses for the domains associated with the submitted e- mail addresses. If any technical errors occur in the selection of a potential winner, Sponsor may award the prize by random drawing from among all eligible claimants.

Sponsor’s use of personal information is subject to Sponsor’s privacy statement, which is subject to change at any time, and available at https://www.missouriquiltco.com/content/privacy.

 

15. Official Rules/Winners’ List
