MISSOURI STAR QUILT COMPANY GOLDEN STAR 2023 PROMOTION OFFICIAL RULES

 

1. Eligibility

 The Missouri Star Quilt Company Golden Star Promotion (the “Promotion”) is open to legal U.S. residents residing in the fifty (50) United States, the District of Columbia, (excluding Guam and all other U.S. foreign territories and possessions), who are at least eighteen (18) years of age or the age of majority, whichever is older, in their respective states of permanent residence as of January 1, 2023. Void where prohibited or restricted by law. Employees of Missouri Star Quilt Company or any of its affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Promotion and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these rules (the “Official Rules”) and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

 

2. Sponsor

The Promotion is sponsored by Missouri Star Quilt Company, Inc. (the “Sponsor”).

 

3. Timing

The Promotion begins on March 14, 2023 and ends until the earlier of March 31, 2023, at 11:59 PM CST or when all Golden Star prize codes are distributed (the “Promotion Period”).

 

4. To Participate

 During the Promotion Period, participants will automatically receive one (1) Golden Star entry game card with each purchase of $10 or more (excluding shipping, handling, and tax) from Sponsor either in person at the store or online at https://www.missouriquiltco.com/ during the Promotion Period. Those who wish to participate without making a purchase may request a free digital game entry by sending a addressed, hand-written postcard, including: Name, Mailing Address, and a valid Email Address, to: Missouri Star Golden Star, P.O. Box 210, Hamilton, MO 64644. Vermont residents can exclude return postage.  All requests must be postmarked by March 31, 2023, and received no later than April 1, 2023.   

5. Prizes

Once the prize voucher has been redeemed, it will be revealed which prize participant has won subject to verification and compliance with these Official Rules. Other conditions and restrictions may apply.  The following prizes will be awarded. The aggregate prize value is equal to: $921,236 USD.

A Golden Star card is valid towards a future purchase at one of Sponsor’s on-site locations and  cannot be combined with any other offer or sold or redeemed for cash. Winner’s will have between April 1,2023 to April 30, 2023, at 11:59 pm CST to redeem the Golden Star card(s). 

 

For all prizes: Prizes are non-transferable. No substitution, cash redemption, assignment or transfer of prize permitted, except by Sponsor, who reserves the right in its sole discretion to substitute a prize with another prize of greater or equal value. All federal, state and local taxes, if any, related to a prize are the responsibility of the individual winner. Limit one prize redemption per entrant per day regardless of entry method.

6. Grand Prize

Fifteen (15) potential grand prize winners (the “Grand Prize Winners”) will be chosen by Sponsor in a random drawing from among all eligible entries received during the entire Promotion Period on or about April 10, 2023

Sponsor anticipates that the potential Grand Prize Winners will be contacted either by phone, email from the email address: info@missouriquiltco.com in writing, or in person via a visit by Sponsor representatives at the Grand Prize Winner’s home or other location on or around April 10, 2023 (subject to change). The potential Grand Prize Winners may be filmed or otherwise recorded during such a visit by Sponsor. Entrants are advised to add info@missouriquiltco.com  to their  safe senders list to ensure that any email notification is delivered to their inbox. The Grand Prize Winners will be required to execute an affidavit of eligibility, a non-disclosure agreement, and release of liability and publicity (where permitted by law), and return same, fully-executed, within five (5) business days of date of issuance of prize notification. If Sponsor is unable to contact the potential Grand Prize Winner within five (5) business days of the initial attempt, if the potential Grand Prize Winner fails to return all requested forms fully-executed by the specified date, or if the potential Grand Prize Winner(s) fails to comply with these Official Rules, including traveling on the dates and times required by Sponsor, his/her place as a possible Grand Prize Winner(s) will be forfeited at Sponsor’s discretion, and an alternate Grand Prize Winner shall be selected. Sponsor reserves the right to select the winner in a random drawing format that shall be determined by Sponsor. Odds of winning depend on the number of eligible entries.

 

7. Prize Claims

Golden Star Prize winners must submit claims online by visiting https://www.missouriquiltco.com/pages/sweepstakes and access the promotion through their account page.  Deadline to submit is April 1, 2023, at 11:59 pm CST. After April 14, 2023, prizes identified lose all value. All entries  are subject to verification by Sponsor. POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.  

8. Verification of Potential Winners

Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential winners will be required to sign and return to Sponsor, within three (3) business days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize if applicable. If a potential winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, or if the prize or prize notification is returned as undeliverable, potential winner forfeits the prize. In the event that a potential winner of a prize is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.

 

9. Second Chance Drawing

On or about May 10, 2023, Sponsor will conduct a random draw of all unclaimed prizes with an approximate retail value in excess of $50. Odds of winning depend on the number of unclaimed prizes and registered entries.

10. Entry Conditions and Release

By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Promotion; (b) release and hold harmless the Sponsor, and its parents, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Promotion, and all of their respective past and present officers, members, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Promotion, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an entrant’s participation in the Promotion and/or entrant’s acceptance, use or misuse of prize.

 

11. Publicity

Except where prohibited, participation in the Promotion constitutes winner’s consent to Sponsor and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

 

12. General Conditions

Winnings are void if not obtained through authorized, legitimate channels, or if any part is defective, altered, duplicated, forged, counterfeited, mutilated or tampered with in any way.  Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, for any reason or if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

 

13. Limitations of Liability 

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Promotion; (d) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

 

14. Disputes

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of entrants and Sponsor in connection with the Promotion effect to any choice of law or conflict of laws rules or provisions. Any legal claims arising from or relating to the Promotion or these Official Rules must be brought in the federal or state courts located in Caldwell County, Missouri.   Entrant agrees that (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (iii) except for residents of the State of New Jersey, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All descriptive headings of sections and paragraphs are intended solely for convenience, and no provision of this Agreement is to be construed by reference to the heading of any section or paragraph. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with the law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable, or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

15. Additional Terms

We may, to the maximum extent permitted by applicable law and in our sole discretion, change

these rules or cancel the Promotion at any time; or modify, terminate, or suspend the

Promotion should viruses, worms, bugs, unauthorized human intervention or other causes

beyond our control corrupt or impair the administration, security, fairness or proper play of the

Promotion or submission of entries. We are not responsible for: (a) lost, misdirected, late,

incomplete, or unintelligible entries or for inaccurate entry information, whether caused by you

or by any of the equipment or programming associated with or utilized in the Promotion, or by

any technical or human error that may occur in the processing of entries; (b) any printing or

typographical errors in any materials associated with the Promotion; (c) any error in the

operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries,

or for technical, network, telephone, computer, hardware or software, malfunctions of any

kind, or inaccurate transmission of, or failure to receive any entry information on account of

technical problems or traffic congestion on the Internet or at any website; or (d) injury or

damage to your or any other computer resulting from downloading any materials in connection

with the Promotion. We may, in our sole discretion, disqualify any individual found to be: (x)

tampering with the entry process or the operation of the Promotion or website; (y) acting in

violation of these rules; or (z) acting in an unsportsmanlike or disruptive manner or with intent

to annoy, abuse, threaten or harass any other person. If your entry is incomplete or if you use

robotic, automatic, programmed or similar entry methods, your entry will be void. The

authorized subscriber of the e-mail address associated with any account used to enter the

Promotion at the actual time of entry will be deemed to be the participant and must comply

with these rules in the event of a dispute as to entries submitted by multiple users having the

same email address. The authorized account subscriber is the natural person who is assigned

an email address by an internet access provider, on-line service provider, or other organization

responsible for assigning email addresses for the domains associated with the submitted e-

mail addresses. If any technical errors occur in the selection of a potential winner, we may

award the prize by random drawing from among all eligible claimants.
